Affiliate Program Privacy Statement

The Affiliate Program at AirHelp views data privacy as a fundamental component of doing business with our affiliates. Both us and Affiliate Solution Tool, Post Affiliate Pro, operate according to EU data protection requirements, including those set out in the General Data Protection Regulation (“GDPR”), which became enforceable on May 25, 2018.

This Privacy Statement applies to www.airhelp.com, owned and operated by AirHelp’s primary operational entity, AirHelp GmbH, based at WeWork Warschauer Platz 11-13, in Berlin, Germany. For the purpose of this Privacy Statement, the terms “AirHelp”, “we”, “us”, or “our”, refers to the whole company group or each of the companies as the case may be.

This Privacy Statement explains the types of information we collect and how we use that information.


Definitions

In this Privacy Statement, unless otherwise defined herein, the capitalized terms below shall have the same meaning as in our Terms And Conditions.


Collection and use of personal data

In order to offer our services to our affiliate Partners, AirHelp needs to be provided with personal data to operate and improve our Affiliate Program.

All personal data is collected in accordance with the GDPR. We will process personal data only to the extent required for a specified, explicit and legitimate purpose or for a purpose required by law in places where we operate.

We primarily collect personal data such as names, email address, physical address and banking details to be able to complete the payment process for our Partners, all in accordance with our Affiliate Terms and Conditions.

While the affiliate website address is stored within our records for performance tracking, AirHelp has at no point ownership nor will store any further information about the affiliate website’s visitors.
Furthermore, we collect personal data for other purposes such as statistics, administration and communication, IT and security administration, physical security, authentication and authorization systems, support systems, collaboration of internal projects and organizational teams and activities.

We will use personal data for the purpose it is collected, and keep the data for no longer than necessary for that purpose. We may retain your information for as long as your Affiliate account is active or as needed to provide services, comply with our legal obligations or any of the purposes listed above.


Use of Cookies

The AirHelp Affiliate Program uses cookies to be able to analyse whether visitors from the affiliate partner’s website are making claims on AirHelp. Cookies are small text files that are placed on the users device to track usage patterns and record preferences. Our cookies do not contain information that can identify persons. We gather certain information automatically by the use of cookies and tracking technologies such as Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, files viewed on our site , operating system and date/time stamp. Website users can control the use of cookies at the individual browser level, but if users choose to disable cookies, it may limit the use of certain features or functions on our website or service.

Sharing of personal Data

As it is necessary to be able to provide our services to our Affiliates, AirHelp needs to share your name, email address, and banking details with the Affiliate software Tool, Post Affiliate Pro, by Quality Unit, s.r.o., Vajnorská 100/A, 83104 Bratislava, Slovakia (European Union).

AirHelp is considered to be the Data Controller and Post Affiliate Pro the Data Processor. Meaning AirHelp will determine the purposes and means of the processing of personal data. This processing by Post Affiliate Pro is governed by a Data Processing Agreement signed by both parties.

We will not disclose personal data to other third parties for the purpose of allowing them to market their products or services to our affiliates.


Access to and rectification of personal data

Post Affiliate Pro provides partners with the right to access and rectify or request erasure or restriction of processing of any information we have collected, at any time, through their Affiliate Panel. To help us offer our service, we request affiliates to update their profile in case of any changes.

Request of total erasure or restriction of processing the collected personal data shall mean the end of the Affiliate Agreement between AirHelp and the partner, as Post Affiliate Pro will delete the data immediately.


Security of processing

We will process personal data securely, apply and maintain appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, in particular where the processing involves the transmission of data over a network, and against all other unlawful forms of processing.


Responsibility

This privacy statement is under the responsibility of the Legal team at AirHelp, who has the overall responsibility to ensure compliance. The data protection officer (DPO) is responsible for the implementation of our data protection policy, which is intrinsically linked to the privacy statement. The DPO is ensuring compliance on a daily basis and is involved in all issues related to the protection of personal data.


Affiliate Email communication

AirHelp is allowed to periodically update affiliates with information which we believe may be of interest to them such as the latest news on our products and services. Partners will always have the right to object to receiving such emails, on request and free of charge, without having to provide specific justifications.

While the partner is able to choose which automated emails our Affiliate Program Solution, Post Affiliate Pro, sends; All direct Email communication related to the performing of the Service between AirHelp’s Affiliate Program and the Affiliate partner, such as invoice reports, technical service and/or legal changes is deemed necessary and thus not possible to be opted out.


Changes to this Privacy Statement

This Privacy Statement may be updated from time to time, e.g. due to modifications of relevant legislation or changes to our corporate structure. If any material changes are made, you will be notified by email prior to the change becoming effective.
