Sitting at the gate watching your departure time get pushed back is a frustrating experience every traveller knows all too well. When your flight hits a 2-hour delay, you might wonder: What am I entitled to? Am I eligible for cash compensation under EC 261?

While European law is widely considered to offer some of the strongest air passenger protections in the world, the rules surrounding a 2-hour delay can be confusing. Here is a breakdown of what rights can kick in at two hours, when financial compensation applies, and what you should do while stuck at the airport.

Can I claim compensation for a 2-hour delay?

The short answer is: generally not, unless the delay makes you reach your final destination 3 hours or more late.

Under EC 261, compensation for flight delays is triggered when you arrive at your final destination 3 hours or more past the scheduled arrival time. Therefore, if your original flight is simply delayed by 2 hours at departure and arrival, you generally cannot claim the €250–€600 compensation set out by EC 261.

A 2-hour delay can be an important threshold for passenger rights. While this duration might not qualify for financial compensation in most cases, on short-haul flights you are still entitled to specific care and assistance from your airline.

EC 261 and the 2-hour delay rule

Under Regulation (EC) No 261/2004 (commonly known as EC 261), passengers benefit from specific legal protections when facing a 2-hour delay. While cash compensation under EC 261 typically requires a 3-hour delay upon arrival at your final destination, for many flights a 2-hour departure delay activates mandatory airline assistance and can lead to financial compensation if your arrival is further delayed.

With a 2-hour delay, the key distinction is between the right to care at the departure airport and financial compensation based on your final arrival time:

  • Right to care at 2 Hours: for short-distance flights (up to 1,500 km), a departure delay of 2 hours or more obligates the airline to provide free food, drinks and communication access immediately.

  • Arrival delay vs. departure delay: under EC 261, compensation is determined by your arrival delay at your final destination, not how late the plane departed from the gate. Arrival time is defined as the exact moment at least one of the aircraft's doors opens after landing, allowing passengers to exit.

For example, if your flight leaves 2 hours late but experiences in-flight rerouting or tarmac holding, resulting in an arrival delay of 3 hours or more, you may qualify for cash compensation.

The right to care: claim while you wait

Even if you’re not entitled to compensation, EC 261 requires airlines to provide care to passengers experiencing significant departure delays. This right to care applies regardless of whether the delay is caused by extraordinary circumstances. The airline must provide:

  • Food & refreshments: meals and drinks in reasonable relation to the waiting time, often provided through vouchers.

  • Communication facilities: access to 2 free phone calls, telex/fax messages or emails.

  • Overnight accommodation & transport: if your delayed flight is postponed to the next day, the airline must pay for hotel accommodation and transfers between the airport and the hotel.

When does right to care apply?

These rights activate at different delay thresholds depending on your flight distance:

  • Flights of 1,500 km or less: after 2 hours.

  • Flights over 1,500 km within the EU: after 3 hours.

  • Non-intra-EU flights between 1,500–3,500 km: after 3 hours.

  • All other flights over 3,500 km: after 4 hours.

Can I claim if a 2-hour delay makes me miss my connection?

You can, if your journey was booked under a single reservation and you reach your final destination 3 or more hours late.

If an initial 2-hour flight delay causes you to miss your connecting flight, the airline will arrange an alternative flight to ensure you reach your final destination. And what counts for compensation is how late you arrive at your final destination, not how late the first flight was. If the missed connection results in reaching your destination 3 hours late or more, you may be entitled to compensation.

Which delayed flights are covered under EC 261?

EC 261 covers you if your flight departs from an EU airport, whatever the airline, or if it arrives in the EU from outside it on an EU-licensed airline. That covers EU countries alongside places like Iceland, Norway, Switzerland and the outermost regions: French Guiana and Martinique, Mayotte, Guadeloupe and La Réunion, Saint-Martin, Madeira and the Azores, and the Canary Islands.
