What is EC 261 and How Does the 3 Hour rule work?

Regulation (EC) No 261/2004 is a key piece of European legislation designed to protect air passengers faced with flight disruptions. Introduced in 2004, the law helps passengers claim compensation for flight cancellations, overbookings and delays.

The key point of the 3 hour flight delay: Under EC 261, compensation is determined by your arrival delay at your final destination, not how late the plane departed from the gate. Arrival time is defined as the exact moment at least one of the aircraft's doors opens after landing, allowing passengers to exit.

For example, if your flight leaves 2 hours late but experiences in-flight rerouting or tarmac holding, resulting in an arrival delay of 3 hours and 1 minute, you may qualify for compensation.


What should I do if Delayed by 3 Hours or More?

Flight delays are frustrating, but rushing into quick fixes can cost you. Staying calm and taking the right steps at the airport will save you significant time and money down the line.

  • Keep all travel documents: All boarding passes, tickets, and travel documents.

  • Ask why: Request written confirmation from ground staff or gate agents explaining the official cause of the delay.

  • Document arrival time: record the exact time the aircraft door opens at the gate. Take photos of the gate display board showing the actual arrival time if possible.

  • Claim basic care: Ask for meal/drink vouchers and accommodation if you're stuck overnight.

The Right to Care: Claim While you Wait

In addition to compensation, EC 261 mandates that airlines provide a "Right to Care" to passengers experiencing significant departure delays. This right kicks in regardless of whether the delay is caused by extraordinary circumstances. The airline must provide:

  • Food & Refreshments: Meals and drink vouchers reasonable to the waiting time.

  • Communication Facilities: Access to 2 free phone calls, telex/fax messages or e-mails, or internet access.

  • Overnight Accommodation & Transport: If your delayed flight is postponed to the next day, the airline must pay for hotel accommodation and transfers between the airport and the hotel.

When does right to care apply?  These rights activate at different delay thresholds depending on your flight distance:

  • Flights under 1,500 km: after 2 hours.

  • Flights between 1,500–3,500 km: after 3 hours.

  • Flights over 3,500 km: after 4 hours.


Which Delayed Flights are Covered Under EC 261?

EC 261 covers you if your flight departs from an EU airport, whatever the airline, or if it arrives in the EU from outside it on an EU airline.. That covers EU countries alongside places like Norway and Switzerland, as well as outermost regions such as Martinique, Guadeloupe, French Guiana, and the Canary Islands.

Can I Claim if a Delay Makes Me Miss My Connection?

Yes, provided your journey was booked under a single reservation (one booking reference/PNR).

Travel itineraries with multiple legs can quickly go off track. If an initial flight delay causes you to miss your connecting flight, don't worry—the airline is obligated to arrange an alternative flight to ensure you reach your final destination. And what counts for compensation is how late you arrive at your final destination, not how late the first flight was.


How Compensation Can I Claim?

Compensation amounts vary based on travel distance and the length of the delay to your final destination. Here are the amounts based on distance:

€250: All journeys covering distances up to 1,500 km.

€400: Internal EU flights over 1,500 km or other trips between 1,500 and 3,500 km.

€600: Non-internal EU journeys exceeding 3,500 km.
